HOW DO WE REGISTER AS DOMESTIC PARTNERS?

Registration of Domestic Partnership is conducted by the Office of the City Clerk. There are two ways to register:

Both partners must appear in person with proof of identity, though the application may be obtained and filled out in advance (the Affidavit of Domestic Partnership must be executed in the presence of the City Clerk or her designee). You must show to the City Clerk or her designee proof of identity by presenting a picture identification card. If both partners live in Oakland, each must show proof of residence within the city limits at the same address, such as a utility bill or bank statement

or

Both partners must appear to a Notary Public to sign the Affidavit of Domestic Partnership. The Affidavit is then forwarded, with proof of cohabitation (a copy for each partner of a bank statement, utility bill, etc.) and fee, to the Office of the City Clerk.

The fee for registration is $40. Once you have filed an Affidavit of Domestic Partnership, you will be registered as domestic partners for an indefinite period. You will receive a copy of your certificate of domestic partnership at the time of registration or within five (5) working days by mail.

TERMINATING YOUR DOMESTIC PARTNERSHIP

Should you end this relationship and live separately for more than ninety (90) days, you must submit a Notice Of Ending A Domestic Partnership with the Office of the City Clerk. The processing fee for the Notice Of Ending is $10 if signed by both parties, $15 if you wish us to inform your former partner of this termination by certified mail. In the case of the death of a partner, a Notice Of Ending A Domestic Partnership is also required to be filed.


How Do We End a Domestic Partnership?

The process of Domestic Partnership Registration is simple. You must meet the following requirements to register as domestic partners with the City of Oakland:

A Domestic Partnership ends when:

  1. One partner sends the other a written notice that he or she has ended the partnership; or


  2. One of the partners dies; or


  3. One of the partners marries or the partners no longer live together

Notice the Partnership Has Ended.

  1. To Domestic Partners.

  2. When a Domestic Partnership ends, at least one of the partners must sign a notice saying that the partnership has ended. The notice must be dated and signed under penalty of perjury. If the Affidavit of Domestic Partnership was filed with the City Clerk, the notice must be filed with the clerk; otherwise, the notice must be notarized. The partner who signs the notice must send a copy to the other partner.

  3. To Third Parties.

  4. When a Domestic Partnership ends, a Domestic Partner who has given a copy of an Affidavit of Domestic Partnership to any third party, (or, if that partner has died, the surviving member of the domestic partnership) must give that third party a notice signed under penalty of perjury stating the partnership has ended. The notice must be sent within 60 days of the end of the domestic partnership.

  5. Failure to Give Notice.

Failure to give either of the notices required will neither prevent nor delay termination of the Domestic Partnership. Anyone who suffers any loss as a result of failure to send either of these notices may sue for actual losses.
