Bid Opening, Award and Execution of Contract

Bid Opening
Bids will be opened, examined and publicly declared at the location and time indicated on page one of the cover sheet. Bidders may review the bids at the bid opening or at a later date by request. A bid summary will be prepared by the Purchasing Division and mailed to bidders on written request.

Award of Bid
For consideration for an award, the Bid must be acceptable and comply with the specifications and legal requirements. The contract will be awarded to the lowest responsible bidder by either the City Council or the Purchasing Manager as indicated in the specifications within thirty calender days of the bid opening. "Lowest responsible bidder" shall be as defined in the City of Oakland Ordinance No. 7937 C.M.S., as amended.

Rejection of Bids
The City may reject any and all bids, and reject a bid of any party who has been delinquent or unfaithful in any former contract with the City.

Contract Documents
The City Specifications, General Conditions, Special Provisions, Bid Bond, or Performance Bond, vendor's approved bid, the Purchase Order and final acceptance by the City Manager shall constitute the documents of contract between the City and the Contractor.

Surplus Material
The City reserves the right to purchase from any public agency, surplus materials, or supplies of the same type as those which it agrees to purchase from the contractor, and such purchase will not constitute a breach of contract entered into pursuant to these specifications.
