                                                                    Persons wishing to address the Commission on any item on the agenda,             including

                                                                    Open Forum and Director’s Report, should fill out a speaker card and give it to the           Secretary “Agenda items will be called at the discretion of the Chair not necessarily

                                                                                                       in the     order they are listed on the Agenda”.  Speakers are generally limited to two

                                                                    minutes at the discretion of the Chair. Applicants and appellants are generally

Agenda items will be called at the discretion of the Chair and not necessarily in the order they are listed on the agenda.  However, a matter identified as an 8:30 p.m. item shall not be called until 8:30 p.m. or later.  The order of items will be determined under "Agenda Discussion" at the beginning of the meeting. With the exception of Open Forum, a new item will not be called after 10:15 p.m., and the meeting will adjourn no later than 10:30 p.m. unless the meeting is extended by the Chair with the consent of a majority of Commissioners present.

Please check with the Planning Department prior to the meeting regarding items that may be continued.  Any agenda item may be continued, without the hearing on the matter being opened or public testimony taken, at the discretion of the Chair.  Persons wishing to address the continued item may do so under Open Forum.

The application was denied by the Zoning Manager on January 11, 2006. 

The approval was subsequently appealed by the appellant on January 23, 2006.

The Planning Commission upheld the appeal and overturned the Zoning Manager’s denial of the application, thus approving the Minor Conditional Use Permit on March 8, 2006.

Action to be Taken:

Adopt Findings for Approval and the Commission may also choose to adopt of Conditions of Approval.

PUBLIC HEARINGS:         

 

The hearing provides opportunity for all concerned persons to speak; the hearing will normally be closed after all testimony has been heard.  The Commission will then vote on the matter based on the staff report and recommendation. If you wish to be notified on the decision of an agenda item, please indicate the case number and submit a self-addressed stamped envelope, for each case.  Planning Commission decisions that involve “major” cases (i.e., major variances, major conditional use permits) are usually appealable to the City Council.  Such appeals must be filed within ten (10) days of the date of the announcement of the Planning Commission decision.  If you challenge a Commission decision in court, you may be limited to issues raised at the public hearing or in correspondence delivered to the Zoning Division, Community and Economic Development Agency, at, or prior to, to the public hearing.

Historic Status:

Although the building at 3741-47 Broadway was considered potentially eligible for local listing as an historic resource, a recent report has concluded that the building is not an historic resource because its integrity has been severely compromised. The Oakland Landmarks Preservation Advisory Board concurred with the conclusions of this report at its regular March 13, 2006 meeting.

Environmental Determination:

An EIR has been prepared by the City. A Notice of Availability/Notice of Public Hearing was distributed to the general public on March 2, 2006.  The public comment period on the Draft EIR ends on April 17, 2006.

The Planning Commission approved a Minor Conditional Use Permit for parking and loading within 75’ of the front lot line; Minor Variances for the rear yard setback, minimum interior courtyard dimensions, and for parking dimensions where adjacent to a column or other obstruction on January 4, 2006. At that meeting, the Planning Commission requested that the exterior façade design of the project be return to the full Commission for a final decision.
