Filing a complaint with CPRB does not prevent a person from also filing with the Oakland Police Department.
Filing a complaint with CPRB also does not prevent a person from filing a claim against the City of Oakland or other governmental agencies or authorities.
The filing of a complaint with the CPRB does not constitute the filing of a tort claim against the City of Oakland pursuant to California Government Code Section 900 et seq.
A complaint is not considered filed with the CPRB until the complainant has submitted a personally signed written complaint or one signed by his/her representative, so designated in writing by the complainant.
It is against the law for a person to make a complaint that the person knows to be false. If a person makes a complaint against an officer knowing that it is false, that person can be prosecuted on a misdemeanor charge. |
