The Council’s number one priority is public safety. 15% of our total budgeted legal services will be devoted to public safety for an equivalent of a total attorney and paraprofessional staff of 9 FTEs.

We will continue our aggressive public safety risk management efforts through our police and fire working groups. Commitments by the management of these departments to reduce liability exposure through policy changes and training will result in continued reductions in the numbers of claims and and will result in our ability to successfully defend actions in trial.

In conjunction with the District Attorney’s office and U.S. Attorney’s Office the Community Prosecution Program will be fully implemented. We are currently negotiating for a district office to provide direct service to the community. Oakland’s program will be a model for coordinated law enforcement and community empowerment.

Oakland has been a leader in it’s innovative legislative efforts to control the proliferation of guns in our community and the City Attorney’s Office will be continuing to bring forth to the Council more legislative initiatives to control gun use and distribution. In addition, we will be actively involved in the prosecution of the recently intitated gun litigation

We will also look at measures to control drug sales and other illegal activities in our communities.

A significant amount of our resources will continue to be devoted to defending actions which are public safety related.

This chart depicts our current inventory of public safety related lawsuits. Currently, we are defending 53 lawsuits which arise out of issues involving police conduct. Also, a critical public safety issue arises as a result of accidents involving city vehicles. Currently, we have 23 vehicle accident cases pending.
