We have initiated a public works risk management working group that meets regularly to discuss public liability risks so that policies and procedures can be initiated to mitigate against potential liability and litigation. The proposed budget increase for sidewalk and street maintenance will significantly assist in alleviating major dangerous conditionsof public property such as the ones shown on this slide.

Cracks1.gif - 262458 Bytes We will be working closely with contract compliance in the development of a Croson disparity study for MBE/WBE participation in contracting.

We will be working with the Public Works Agency to review and streamline standard contract documents to make them user friendly, without compromising legal requirements and protections.

The resolution of drainage issues is a significant issue that we are actively involved in as participants on the drainage task force.

Public works and parks department litigation is a large part of our litigation practice. Most of our claims, which are resolved prior to a lawsuit being filed, arise out of sewer backups or breaks and from damaged streets and sidewalks.

The bulk of public works and parks department lawsuits, of which there are currently 117 pending, arise out of injuries sustained as a result of alleged dangerous conditions of public property. Our most complex and potentially costly suits, however, are inverse condemnation actions.
