NOTICE OF TERMINATION OR SUSPENSION

(The purpose of this letter is to inform employees of a decision on

disciplinary action after the pre-disciplinary (Skelly) meeting.)

RE: Notice of Termination (or Suspension)

Dear (Employee Name):After carefully considering your oral (or written, or oral and written) response on (date) to the Notice of Intent to Terminate (or to Suspend) letter dated (date), I have decided that it is appropriate to proceed with the action terminating (suspending) you from your job of (job title) effective at the end of your regular work shift on (date) (in case of suspension, state beginning and ending date of suspension). You are to return to work at your regular scheduled starting time on (date).

By your actions you have violated the following:

  1. Violation of City Ordinance – Incompetence.
  2. Violation of City Administrative Instruction No. 111 –Careless or unsatisfactory workmanship.
  3. Violation of Department work rules.

The above grounds are based on the following acts or omissions:

(Set forth clearly and specifically all of the details, dates, places, and events which give rise to the action; essentially, you may duplicate the provisions of the Notice of Intent letter.) Example:Specifically, on March 15, 1999, you were assigned to build a booth for a public service event at which City employees were to distribute City brochures. The design for the booth was provided to you, and included a list of specified materials that you were to use. However, you did not use the materials specified for the design, which resulted in a booth that was not sturdy enough to withstand minor wind gusts. Further, you did not make your supervisor or anyone else aware of the change in materials. As a result, another City employee was injured when the booth blew over in a gust of wind at the public service event.

This action is being taken because the following prior disciplinary actions proved ineffective:

(List all previous disciplinary actions; essentially you may duplicate the provisions of the Notice of Intent letter.) Example:August 20, 1998. Warning memo for failing to sand a wooden hand rail.December 3, 1988. One day suspension for unauthorized use of City equipment.

In addition, I have counseled you on many occasions regarding the need to follow work plans and designs, or, to check with your supervisor before making significant changes.

(Paragraph including a brief recital of what the employee said during the "Skelly" meeting and why the decision maker accepted or rejected the employee's response in making a final decision.) Example:On (date) you met with (Skelly officer) so that you could respond to the facts upon which the recommendation for discipline was based. In the meeting, you said that you believed the materials specified in the design were too heavy and would prevent easy dismantling of the booth, which could possibly lead to injury. When asked why you did not check with your supervisor first, you said that you relied on your own experience with materials and construction and did not think it was necessary.

You are hereby notified that you may file a grievance regarding this action, as provided for in (cite appropriate memorandum of understanding or administrative instruction). If this action is subject to judicial review under CCP Section 1094.5, be advised that the time within which judicial review must be sought is governed by CCP Section 1094.6. (For suspensions substitute the following for this paragraph: "Further, you are instructed that future occurrences of this or similar incidents will lead to more severe disciplinary action or termination. You are hereby notified that you may file a grievance regarding this action, as provided for in (cite appropriate memorandum of understanding or administrative instruction).
