Why is there a discrepancy between Zoning Code and General Plan? |
| The General Plan was recently updated in 1998. When the update happened it created numerous discrepancies between the Current Zoning Code (adopted originally in 1965) and the new General Plan. Often this was due to raising or lowering intensities of residential uses in certain areas of the city but there could be greater discrepancies including a complete change in use (from manufacturing to residential uses for example). The Zoning Code is currently being updated that will bring it into conformance with the General Plan and eliminate these discrepancies and we anticipate that this process will be complete sometime in the year 2004. Until that time however it is essential for you to check both designations. |
How may this affect you? |
| For example you may search for a property and find that it is zoned R-50 Medium Density Residential which would allow small apartment buildings. However you then find that the General Plan Designation for that property is Detached Unit Residential. This General Plan designation only allows 1 single family detached house per lot to be constructed. Existing multi-family units could remain but they likely would not be able to expand. All new developments need to conform to the General Plan, irregardless of what the Zoning District might currently allow. |
