1. The City is targeting illegal dumpers with its Litter Enforcement Officer team. If you see illegally dumped material—or someone in the process of dumping—call the Illegal Dumping hotline at (510) 615-5566.

2. Response time depends upon the material, amount and location. Public Works tries to respond that day, but will definitely respond within one week.

3. Litter Enforcement Officers will investigate the illegally dumped material and cite the offender. Meanwhile the City will remove the material.

1. To remove a blight or Code violation in the City of Oakland—such as overgrown weeds in someone’s yard, or a house with broken windows—first determine whether it is possible or preferable to talk directly to the property owner about your concerns. Understand that by calling the City, a process may be set in motion that could eventually cost the property owner thousands of dollars in fines and penalties.

2. To involve the City, call the Community & Economic Development Agency’s Code Enforcement unit at (510) 238-3381. A staff member will ask you for information regarding the property address and the type of violation that you have observed. A Code Enforcement Inspector will be sent to the address within the next three to five business days. If the blight is inaccessible because it is inside the house, or in a locked backyard, the process will be delayed while the inspector obtains a warrant to enter the premises.

3. If the inspector determines that the property is blighted, as defined by the Oakland Municipal Code, a “Notice to Abate” letter will be sent immediately to the property owner. This letter will alert the property owner that he or she has a certain number of days to “abate,” or remove the blight—usually ten days.

4. The inspector will return to the property 16–30 days after the Notice was sent, to determine whether the blight has been abated. If it has not, the person will be fined $801 (or the prevailing fee established in the City’s current Master Fee Schedule). If the person has complied with the Notice, there will be no fine.

5. If the property owner does not comply, the City will clean up the property as soon as possible. Usually, completing the cleanup takes several weeks, depending on the problems encountered in working with the property owner. The costs that the City incurs in cleaning the property will be added to the original $801 fine.

6. If the property owner cannot or will not pay the fines, then the property will be liened. After one year, or when the property is sold or changes ownership, the fines will be transferred to the owner’s property taxes.

1. Response time depends on type of problem and time of day that call is received. Response is either same day, or next day.

2. Place your garbage, yard trimmings and recycling carts at the curb no earlier than 5pm on the day before your scheduled collection and remove bins by 9pm on the day of your collection. Garbage carts may not be stored in front of your house, or anywhere where they can be seen from the street.

A missing or damaged trash container will be replaced within the week, if possible. However, if no trash cans are available, replacement could take up to one year.

The City’s contract with Waste Management of Alameda County allows the City to add 75 new containers per year. If containers are available and the quota has not been reached, then a new trash receptacle can be added immediately. If the quota has been reached, or no new cans are available, then it could take much longer (up to a year) to get a new trash receptacle added.

All properties must have garbage service, and property owners cannot have more garbage than fits in their trash cans. Inspection will occur within five days. Waste Management will be instructed to increase billing and service level immediately following inspection.

Graffiti

1. Graffiti attracts more graffiti if it is allowed to remain. To report graffiti on public property, call the Graffiti Abatement Hotline at (510) 238-4703. Leave a message with the address and specific location of the graffiti, and a telephone number where you can be reached. The Graffiti Abatement Unit will attempt to remove the graffiti within 24 hours, and will contact you to let you know the timeline for removing it, based on the current workload.

2. If you see graffiti on private property, and cannot address the problem by working with the property owner, call the Code Enforcement Unit at (510) 238-3381.
